PESHAWAR: The Peshawar High Court (PHC) on Wednesday restored promotion of 138 assistant sub-inspectors (ASIs) to the post of sub -inspectors and declared the provincial government decision as void.
A two-member bench comprising Justice Waqar Ahmad Seth and Justice Musarrat Hilali declared the demotion notification of 138 police officials as void.
During hearing, the petitioners’ lawyers Ijaz Anwar and Zartaj Anwar submitted before the bench that the Khyber Pakhtunkhwa Police Department in August 2015 promoted the petitioners from ASI to Sub-Inspectors (SIs), in which some were promoted through Public Service Commission while some were rankers.
They contended that after the promotion, the provincial government withdrew its promotion notification and demoted their designations as ASIs.
They stated that the posts were allocated for the new traffic wardens in the department and under the law promotion they cannot be demoted without any solid and legal reasons.
They said the government’s decision to demote the petitioners was illegal and against the law and thus the decision should be declared void. At this, the bench declared the provincial government’s notification as void and restored them as sub-inspectors.
