PESHAWAR: The administration of Islamia College University under an acting vice-chancellor is defiant not to allow its permanent registrar to resume his official duties despite issuance of two interim orders maintaining the legal status of the officer concerned on April 22.
A division bench of the Peshawar High Court comprising Chief Justice Waqar Ahmad Seth and Justice Naeem Anwar heard two writ petitions of unseated Registrar Dr. M. Tauqir Alam last Thursday along with a contempt of court application submitted by the petitioner against the acting Vice Chancellor, Prof. Dr Nausahd Khan and Prof. Dr. Tariq Jan who is a representative of particular faction of Teaching Staff Association possessing control of Registrar Office since March 4 last.
The writ petition of Dr. Tauqir versus acting VC ICU Prof. Dr. Naushad and 10 other activists and office-holders of the association came up for hearing on 16th April before a division bench of PHC comprising Justice Roohul Amin and Justice Nasir Mehfooz. The petitioner challenged his transfer from the post of registrar and his replacement with Prof. Dr. Tariq Jan.
The bench had given an interim order wherein it was said that the registrar shall not be dislocated from his post till filing of comments on certain legal aspects of petition by the acting VC and other respondents.
The same petition clubbed with a previous petition No: 5735/2019 of Dr. Tauqir Alam came up for hearing on April 22, wherein his and other three officers of grade 20 removals through a fact-finding Governor’s Inspection Team Report in October 2019 had been challenged.
A learned bench of PHC headed by its Chief Justice had granted interim relief to petitioners in this petition. These petitions accompanied a COC, which Dr. Tauqir submitted against Dr. Naushad and Dr. Tariq Jan for transferring him from his post despite PHC interim relief and also in violation of the provisions of KP Universities Act 2012. The bench on April 22 maintained interim reliefs in both the petitions, directing the respondents to submit their comments through their counsels on May 6 next. However, in defiance of these clear-cut orders of the high court, the interim administration of the Islamia College University under acting VC Dr. Naushad and a particular group of Teaching Staff Association office-holders and members, has been constantly opposing the return of permanent registrar to his office.
