Justice Syed Mazahar Ali Akbar Naqvi of the Lahore High Court on Thursday referred a petition to chief justice for constitution of a larger bench to decide whether or not its registrar office could put objection to constitutional petitions filed in LHC.Advocate AK Dogar appeared on behalf of the petitioner and argued that under article 190 of the Constitution, petitions are filed in LHC against violation of fundamental rights enshrined in the Constitution but the registrar office put objection to them which is tantamount to assuming judicial power. He pointed out that it was the prerogative of court to declare a petition maintainable or non-maintainable but registrar has delegated this power to clerks. He further argued that putting objection to petition by registrar office is impeding the way for speedy and timely dispensation of justice.
