PESHAWAR: The Peshawar High Court (PHC) on Friday issued a notice to the Khyber Pakhtunkhwa government in a writ petition filed against creation of surplus pool
in the Health Department for professors, paramedics and other servants of teaching hospitals across the
province.
A single bench headed by Justice Waqar Ahmad Seth issued the notice to the provincial government through chief secretary and coordinator of Health Sector Reforms Unit, directing them to submit replies in the case.
The writ petition was filed by the Provincial Paramedical Association through its president Syed Roidar Shah and general secretary general Muhammad Riaz Burki. The court stated in its order that the creation of surplus pool was in violation of sub-sections 2 and 3 of section-16 of Khyber Pakhtunkhwa Medical and Teaching Institutions Reforms Act 2015 and the petitioners could file an application in the court if the surplus pool was created in the Health Department.
Shumail Ahmad Butt appearing for the petitioners said the creation of surplus pool in Health Department and withdrawal of services of the senior doctors and other servants of the teaching hospitals was an illegal and unlawful act and against the Pakhtunkhwa Medical and Teaching Institutions Reforms Act 2015.
The court had already issued notice in another similar writ petition filed by the Pakistan Medical Association (PMA) Khyber Pakhtunkhwa chapter through its president Dr Hussain Ahmad Haroon.
