House privacy case: PHC seeks feasibility report, PC-1 of BRT
PESHAWAR: The Peshawar High Court (PHC) on Wednesday sought feasibility report and PC-1 of the Bus Rapid Transit (BRT) project from the Peshawar Development Authority (PDA).
A division bench comprising Chief Justice Waqar Ahmad Seth and Justice Musarrat Hilali directed the PDA through its legal advisor to submit the feasibility report, PC-1 and PC-2 of the project before next hearing to be held on April 23.
The bench sought the report in a writ petition filed by a citizen, Adnan Afridi, against the construction of 16 feet high ramp of a BRT station alongside his house, breaching his house privacy.
The counsel for the petitioner submitted that the BRT station No 31 was established outside the house of the petitioner. He pointed out that in the case of the petitioner, the respondents compromised the privacy of the house and the whole house would be visible to passengers while climbing on the ramp for the bus in the station. The bench observed that the court had taken the notice in the BRT project and the NAB had also prepared inquiry report, but it was sealed after the government got a stay order over the high court’s case from Supreme Court of Pakistan. Barrister Waqar Khan, legal advisor of PDA, appeared and submitted that the station has already been constructed. However, the bench observed that the court wants to see the feasibility report and PC-1 and PC-2 of the project to examine whether the changes were made to the station.
