Conviction in narcotics case set aside

PESHAWAR: A division bench of Peshawar High Court (PHC) on Tuesday acquitted three convicts of life term sentenced for smuggling huge quantity of narcotics.
A two-member bench comprising Justice Syed Afsar Shah and Justice Muhammad Ayub Khan acquitted three convicts including Zafar, Wazir Gul and Ikramullah, who were awarded life imprisonment by the Special Anti-Narcotics Court in 2013 for smuggling 325 kilogram hashish in a truck. They had appealed against the conviction.
During the course of hearing, Asad Danial Chamkani and Muzammil Khan, counsels for the convicts, submitted that they were arrested by the Customs authorities for smuggling 325 kilogram hashish and were awarded life imprisonment in the case.
However, they argued that there were major errors in the investigation of the case and law was not followed.
The lawyers pointed out that first the officials took only 15 kilogram hashish as sample for Forensic Science Lab (FSL), but under the law the whole quantity should have been sent to the laboratory.
The lawyers pointed out that Marasila and case property was not prepared on the spot and rather it was prepared in the computer against the law.
The lawyer requested the court that the appellants had undergone three years in the prison while the officials manipulated the case and so they were liable to be acquitted.
