PHC extends stay order in Gomal Medical College appointment case

PESHAWAR: The Peshawar High Court (PHC) on Monday extended stay in the appointment of senior registrars, professors, associate professors and assistant professors in the Gomal Medical College Dera Ismail Khan till the next order.

A two-member bench comprising Justice Qalandar Ali Khan and Justice Muhammad Nasir Mehfooz was hearing the case.  On previous hearing, the court in a writ petition by 29 doctors including Dr Shaukat Ali, professor physiology of Gomal Medical College, Dera Ismail Khan, had stayed the appointments and suspended the advertisement issued on April 19, 2017.

The court also issued notice to secretary health, secretary law and director general health department to submit reply in the writ petition before the next hearing. Umar Farooq Advocate appeared for the petitioners in the case.

It was submitted in the writ petition that advertising the posts as patently illegal and ineffective upon the fundamental rights of the petitioners as envisaged under Article 4 to 25 of the Constitution on the ground that the act the advertising the faculty positions (in some instances already occupied by the petitioners) is in direct conflict of Health Department Government of Khyber Pakhtunkhwa (Teaching Cadre) Recruitment Rules, 2015.
