No comments from LEAs on two year old case irks SHC
The Sindh High Court (SHC) took exception to non-filing of concerned law enforcement agencies’ comments in a missing persons’ case filed two years ago, on Monday.
Strongly objecting to non-filing of comments by the concerned law enforcement agencies on petition of, Farhana, against alleged detention of Syed Musab Bin Sajjad, the court directed the federal and provincial law officers to obtain instructions from the concerned LEAs regarding whereabouts of the detainee. The man was stated to have been missing since October 28, 2014 from Nazimabad.
The court observed that the situation was indeed alarming that despite the matter being in court for a long time no comments had been filed by the concerned departments.
Petitioner Mohammad Liaqat maintained in court that his son, Waheed Khan, went missing on March 12, this year, from Frontier Colony but the police had not been making any efforts to recover his son ever since his disappearance.
The Sindh Rangers and Counter Terrorism Department (CTD) in their respective comments on the petition denied having the petitioner’s son under their custody. The court directed the provincial police chief to make efforts to trace whereabouts of the petitioner’s son and submit a report on the next date of hearing.
In the detention case of Nazmeen Khan who was allegedly picked up from Sachal on July 23, the court directed SHO Sachal police station to register an FIR against alleged detention of Khan if cognizance was made out. The court also directed federal and provincial law officers to file comments on the petition by October 11.
SSP Malir was also directed to ensure appearance of the IO, probing the alleged disappearance of Mirza Saud Baig from Karachi airport, in court on October 23. Petitioner Wajeeha Yaqoob submitted in the petition that her spouse was deported from Dubai and taken into custody by the LEAs on September 1 as soon as he arrived at the airport.
The court also directed provincial law officer to submit the joint task force’s report on missing persons Mohammad Saleem and Mohammad Anees.
