SHC issues notice to FIA on plea against detention of suspected Afghan national

The Sindh High Court (SHC) on Friday issued notices to the Federal Investigation Agency (FIA) and others on a petition against alleged illegal detention of a suspected Afghan national allegedly by personnel of law enforcement agencies.

The petitioner, Afshan Asif, submitted in the petition that her spouse Sardar Mohammad Asif Naqshbandi was picked up by personnel of law enforcement agencies on December 17 from the Gulistan-e-Jauhar area and his whereabouts were unknown.

She submitted that the detained man was earlier deported by the Federal Investigation Agency (FIA) authorities after declaring him as Afghan national however the Afghanistan government refused to verify him as an Afghan national after the judgment of an Afghanistan court.

The petitioner submitted that the detained man was the father of her children and had been running a restaurant and he was not involved in any criminal activity. The high court was requested to direct the FIA and other law enforcement agencies to produce the detained man and provide detail of cases, if any, against him.

A division bench of the SHC headed by Justice Mohammad Faisal Kamal Alam after a preliminary hearing of the petition issued notices to federal and provincial law officers, FIA and others and called their comments on January 9.

Plea of nursing college

The SHC directed the health department and others to submit a compliance report with regard to enrolment of students in a nursing college. The petitioners had submitted that despite the court orders and announcement of the federal government, a private nursing college was not allowing enrolment of students.

A counsel for the petitioners submitted that students’ precious academic year had been affected due to delay by the Pakistan nursing and Midwifery Council and requested the SHC to direct the respondents to implement the court orders and ensure enrolment of the students for the academic year.

The SHC directed the Nursing and Midwifery Council and other respondents to file a compliance report on next date of hearing.
