RAWALPINDI. Judge Amjad Ali Shah of Anti-Terrorism Special Court Rawalpindi has issued show-cause notices director generals of the Federal Investigation Agency (FIA) and Immigration in the GHQ attack case.
The show-cause notice was issued after Usman Dar, an accused in RA Bazaar case regarding the May-9 incident, fled abroad. The show-cause notice said the prosecution had pointed out that Usman Dar, the main accused in case No. 708, registered at RA Bazaar police station, fled to the United States, and the two departments failed to stop him.
On October 31, the court had directed both DGs of the FIA and Immigration that no accused should go abroad without prior permission of the court. Thus, the negligence shown by both officers was a violation of Section 28 of the Anti-Terrorism Act 1997. Although the court fixed a date for filing indictment in the case, no one had been arrested. The absence of the accused would hinder the indictment and cause delay in the trial of the case.
The court directed the two officers to file written response; otherwise, contempt of court action would be taken against them under Section 37 of the Anti-Terrorism Act, 1997.
The court ordered both officers to submit their response by Nov 22; otherwise, their right to defend would be forfeited.
