The Sindh High Court (SHC) on Monday issued notices to the cooperative housing societies registrar and others on a petition against encroachments and failure to hand over possession of houses to allottees in the Gulshan-e-Mehran Housing Society in Malir.
The petitioner, Waqf Shah, submitted in the petition that lawful allotees of Gulshan-e-Mehran had been deprived of their properties although they had completed all the formalities. He submitted that the construction and development work was not being allowed by the authorities in an unlawful manner depriving the petitioners from their properties. He submitted that no proper annual general meeting had been called by the cooperative housing societies registrar to run the affairs of the society.
The high court was requested to direct the authorities to remove hindrance and
obstruction in the development work of the society. The SHC was also asked to direct a Malir civil judge to decide the case of society in the light of the Supreme Court orders.
The petitioner also requested the SHC to direct the society to hand the possession of the plots over to the allottees and hold elections of the society as per the by-laws. After the preliminary hearing of the petition, the high court issued notices to the respondents and called their comments.
