ISLAMABAD: Another petition was filed in the Supreme Court on Thursday challenging the Supreme Court (Practice and Procedure) Amendment Ordinance 2024.
The petition was filed by Akmal Khan Bari under Article 184(3) of the Constitution, making the Federation of Pakistan through the secretary Ministry of Law and Justice and secretary Cabinet Division as respondents
The petitioner prayed the apex court that the impugned notification No. F.2(1)/ 2024-Pub, dated 20th of September, 2024 may very graciously be declared to be illegal, void, extra constitutional and of no legal consequences in the interest of justice, fair play and equity.
He submitted that the president of Pakistan has promulgated an impugned ordinance No. VIII of 2024 on September 19, 2024, notified vide notification No. F.No. 2(1)/2024 – Pub, bringing certain amendments in the Supreme Court (Practice and Procedure) Act 2023, purportedly restoring the arbitrary, capricious and dictatorial powers of the Chief Justice of Pakistan.
The petitioner contended that the impugned ordinance is purported to defeat the aim and objective of the Supreme Court (Practice and Procedure) Act 2023 and has been promulgated in violation of the principles and cannons, governing the legislation, amendment and promulgation of ordinances.
