PHC to hear petition against ordinance on 8th

PESHAWAR: The Peshawar High Court (PHC) will hear the writ petition filed by the District Bar Association (DBA) Peshawar against the Supreme Court (Practice and Procedure) Amendment Ordinance 2024 on October 8.

A two-member bench of the PHC will hear the petition filed by the association’s Vice-President Chaudhry Ishtiaq Ahmad Khan Advocate.The federal government, Law Ministry, president and prime minister, Election Commission of Pakistan and others have been made respondents in the case.

The petitioner said that the ordinance had been promulgated at a time when the National Assembly and Senate were incomplete as far as the number of members was concerned.It was stated that a wrong had been done to Khyber Pakhtunkhwa as far as the election for the Senate and reserved seats in the National Assembly were concerned.

The petitioner said that KP had been deprived of reserved seats in both parliament houses.It was stated that the Supreme Court (Practice and Procedure) Amendment Ordinance 2024 and the proposed constitutional amendment was against the spirit of the free judiciary.

The petitioner pointed out that the number of members in both houses of the parliament should be completed before amending the constitution which is done by a two-thirds majority.The court was requested to declare the Supreme Court (Practice and Procedure) Amendment Ordinance 2024 unlawful and null and void. Besides, the government should be stopped from moving the constitutional amendment in the house as the parliament was incomplete because of the non-allocation of the seats reserved for women and minorities.
