PESHAWAR: The Peshawar High Court (PHC) on Tuesday stayed the appointment of dean of Khyber Medical College till the next order. A two-member bench comprising Justice Waqar Ahmad Seth and Justice Musarrat Hilali issued the stay order in a writ petition filed by Professor Dr Jamshed Ali.
The bench sought reply from selection committee for the dean of Khyber Medical College, secretary Board of Governors Khyber Teaching Hospital, secretary Health Khyber Pakhtunkhwa and PMDC, directing them to submit reply before next hearing of the case.
During hearing, the petitioner’s lawyer Mohibullah Kakakhel informed the bench that the petitioner had remained head of Pharmacology and vice principal of the Khyber Medical College. The lawyer submitted that as per the criteria of the post in the MTI Act, no government servant in the health department would be appointed on the post as the retired qualified person would be appointed as dean/principal of the Khyber Medical College.
He submitted that the provincial government had also reservations on the appointments of government servant on the posts against the MTI Act and also sent a letter to PMDC in this regard.
