SC de-lists ECP appeal due to non-availability of judge

It was prayed in application that instant appeal may be adjourned till return of counsel

ISLAMABAD: The Supreme Court (SC) on Sunday delisted the appeal of Election Commission of Pakistan (ECP) due to non-availability of Justice Jamal Khan Mandokhel.

A five-member larger bench of the apex court headed by Chief Justice Qazi Faez Isa was scheduled to hear todaay (Monday), the ECP appeal against the judgment of Lahore High Court appointing eight election tribunals in Punjab for addressing the election disputes case from February 8 elections.

Other members of the bench included Justice Amin-ud-Din Khan, Justice Jamal Khan Mandokhel, Justice Naeem Akhtar Afghan and Justice Aqeel Ahmed Abbassi.

However, according to a notice, issued by the Assistant Registrar for Registrar Supreme Court all the advocates, Advocates-on-Record (AoRs) concerned and litigant public were informed that the instant appeal fixed before the five-member bench has been delisted due to non-availability of Justice Jamal Khan Mandokhel.

It is pertinent to mention here that senior advocate Hamid Khan, counsel for Salman Akram Raja the other day had filed application for adjournment of the instant appeal. It was submitted in the application that Hamid Khan, counsel for Salman Akram Raja is out of country until September 6, 2024 and who had also given an application earlier for general adjournment.

It was prayed in the application that the instant appeal may be adjourned till return of the counsel.
