ISLAMABAD: The sisters of PTI founding chairman Imran Khan on Friday asked Chief Justice of Pakistan (CJP) Qazi Faez Isa to recuse from benches hearing cases of former prime minister.
Aleema Khan and Uzma Khan moved a direct application in the name of Justice Isa, also demanding the CJP withdraw his observations recently given during the case related to commercial activities on and around the Pir Sohawa Road in National Park at Margalla Hills.
“The observations given by you in case of Wildlife (Monal case) be withdrawn and further you should not be part of any case in which our brother is party,” both the sisters submitted in the application.
Similarly, Aleema and Uzma submitted that they reserved their right to approach the Supreme Judicial Council (SJC) on the issue.
They said that they came to know that the CJP had passed comments about the pending case of their brother regarding £190 million. “Although the said wildlife case has no nexus with £190 million case, however, your observations would badly affect the trial of the case,” they submitted. In the application they cited the notification dated September 2, 2009, issued by the Supreme Judicial Council secretary whereby a judge being the justice of the prestigious court of law is duty bound to follow the code of conduct as enshrined in Article II.
Meanwhile, the Registrar’s Office refused to receive the application stating that a direct application in the name of chief justice cannot be received, advising them to file it through a proper channel. Later, Haleema Khan and Uzma Khan sent the application by post.
