SC takes up ECP’s appeal against LHC order on election tribunals today

A five-member larger bench of the apex court headed by CJP Faez Isa will hear the appeal

ISLAMABAD: The Supreme Court will today (Thursday) take up the appeal of Election Commission of Pakistan (ECP) against the decision of Lahore High Court (LHC) forming eight election tribunals for hearing the election disputes.

A five-member larger bench of the apex court — headed by Chief Justice of Pakistan Justice Qazi Faez Isa — will hear the appeal.

The bench comprises Justice Amin-ud-Din Khan, Justice Jamal Khan Mandokhel, Justice Naeem Akhtar Afghan, and Justice Aqeel Ahmed Abbasi.

On June 13, the electoral body had filed an appeal with the apex court under Article 185(3) of the Constitution against the judgment of Lahore High Court judge Justice Shahid Karim dated May 29, 2024 passed in the petition filed by one Rao Hashim Omar Khan and others.

The Commission had sought leave to appeal against the impugned judgment of Lahore High Court, contending that under Article 219© read with Article 222(b) of the Constitution the power to appoint election tribunals was vested in the electoral body.

The ECP had further contended that Article 219 © of the constitution did not expressly require consultation by the Election Commission with the chief justice of high court concerned for appointing election tribunals or for allocating territorial jurisdiction to such election tribunals.
