Joining civil service without written test: PHC issues notices to FPSC, others

Petitioner submitted to the court that appointments were made in the civil service through the Public Service Commission

PESHAWAR: The Peshawar High Court (PHC) on Thursday issued notices to the Federal Public Service Commission (FPSC) and others in a petition filed against the induction of the security forces men into civil service without any test.

The two-member bench comprising Justice SM Attique Shah and Justice Shakil Ahmad heard the petition filed by Ali Azeem Afridi Advocate.

The petitioner submitted to the court that appointments were made in the civil service through the Public Service Commission. He said the process included proper written tests and interviews.

Ali Azeem Afridi said the Public Service Commission recommended the appointments of the candidates if they succeeded in the tests and interviews.

The petitioner pointed out that the members of the security forces too joined the civil service but were recruited only on the basis of interviews without appearing in any written test.

Ali Azeem Afridi said the members of the security forces had different professional training but despite that, a way had been paved to make them part of the civil service.

The petitioner said there was no such category for the lawyers and other citizens of the country to make them part of the civil service as was being done in the case of members of the security forces.

Ali Azeem Afridi said if the procedure for appointing security forces members was the right one, then it should be extended to the lawyers and other citizens as well.

He said the categorization in the civil service was a glaring violation of basic human rights and in conflict with the Constitution.

The petitioner said he had challenged Rule No 3 of the Civil Service of Pakistan (Composition and Cadre) Rules 1954 which had exempted the armed forces members from appearing in any written test for joining the civil service.

He said either the exemption rule should be declared against the law or lawyers and other citizens should also be allowed to benefit from this facility.

The bench issued notices to the KP government, Law secretary, Establishment Division, the principal secretary to the governor and Federal Public Service Commission to seek their replies.
