ISLAMABAD: The Pakistan Bar Council (PBC) has termed the formation of the Judicial Commission, headed by Supreme Court (SC) Chief Justice Nasirul Mulk with other two SC judges as its members, being a violation of Article 225 of the Constitution.
The Pakistan Bar Council (PBC) Executive Committee Chairman Mohammad Ahsan constitution of Judicial Commission to investigate allegations of rigging in the General Election 2013.
Mr Bhoon deplored that the constitution of the Judicial Commission was an attempt to involve the judiciary in the political matters which, he apprehended, would undermine the image of the highly esteemed institution.
He said that SC chief justice and judges should, therefore, not be a part of the Commission.Since the Constitution provides a full-fledged mechanism of addressing grievances of an individual if he feels dissatisfied with the result of elections or alleges that the same is rigged and a proper constitutional forum exists in the shape of Election Tribunal and the Election Commission of Pakistan (ECP”, there is no need to constitute such a commission,” Ahsen Bhoon said.
He also took strong exception to what he called very hasty statement of Iftikhar Muhammad Chaudhry, former Chief Justice of Pakistan announcing that he would appear before the Judicial Commission as a party.
“His undue haste in giving the statement just after constitution of the Judicial commission, gives an impression of his being guilty conscious for having played some role in the last general elections favouring the present ruling party otherwise he should have not issued such a hasty statement and indulged himself in the controversy of rigging of elections,” Mr Bhoon said in a press release issued here by Pakistan Bar Council (PBC).
