Plea allowed for manslaughter FIR against Malir DC, others over child’s manhole death
A sessions court has directed the Shah Latif Town SHO to record the statement of a man who sought a manslaughter FIR and legal proceedings against the Malir deputy commissioner, officials of the Malir Development Authority (MDA) and local body representatives over the death of his grandson in an open manhole.
Additional Sessions Judge (Malir) Muhammad Ashfaque Mughal allowed an application filed by Ghazi Khan, who sought directives for the SHO to lodge an FIR against proposed accused -- the Malir deputy commissioner, officials of the MDA, and local government representatives of the UC-2.
"I found that the matter pertains to very serious nature [of] allegations against the proposed accused persons, which requires a proper and detailed enquiry into matter," the judge observed.
He directed the SHO to record the statement of the applicant, Ghazi Khan, as per his verbitum and receive the documents if any and then proceed against the proposed accused persons as per law.
Advocate Khalid Shar, the applicant's lawyer, contended that his client's grandson, Mohsin, aged three to four years, died after falling into an open manhole in Shah Latif Town on March 21. He claimed that the child died due to negligence on the part of the proposed accused because they failed to fullfil their duty by leaving a manhole uncovered. The court was pleaded to order the registration of a qatl-bis-sabab case against them.
