ISLAMABAD: The Supreme Court on Friday referred the petition of the federal government challenging the anti-narcotics law passed by Khyber Pakhtunkhwa for consideration by a larger bench.
A three-member bench of the apex court, headed by Justice Syed Mansoor Ali Shah, presided over the case.
The court directed the matter to a three-member committee established under the Supreme Court (Practice and Procedure) Act, 2023, to form a larger bench.
Furthermore, the court stated that an amicus curiae (friend of the court) would be appointed to assist in the matter at hand.
It was noted by the court that the dispute pertains to the jurisdiction of the apex court under Article 184(3) and involves a disagreement between the federal and provincial governments regarding legislation.
The court raised the question of whether a legislative dispute between two governments could be considered a dispute, marking it as a significant aspect of the case. Additionally, the court declared that the definition of criminal law would be examined during the case’s hearing.
