PHC disposes of writ for disqualification of Imran Khan

PESHAWAR: The Peshawar High Court (PHC) on Tuesday disposed of a writ petition filed for the disqualification of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan.

A two-member bench of the PHC consisting of Chief Justice Ishtiaq Ibrahim and Justice Waqar Ahmad heard the petition.

Qazi Jawad Ihsanullah Qureshi appeared for the petitioner, Inamullah. Changes Khan, an associate of senior lawyer Qazi Muhammad Anwar, represented former prime minister Imran Khan.

The court admitted a supplementary petition in this regards and told the petitioner that he could file the petition again in this type of case if he wanted so as Imran Khan was no longer the member of national assembly from NA-35 in Bannu.

The petitioner had said he contested the last general elections from Bannu as a candidate of the Justice and Democratic Party headed by former chief justice of Pakistan, Iftikhar Muhammad Chaudhry and lost to Imran Khan.

He said Imran Khan had not mentioned his alleged daughter and assets of his wife in the nomination papers and thus submitted a false affidavit. The petitioner said Imran Khan was not truthful and trustworthy as per article 62 and 62 of the Constitution. He had said the PTI founder could not contest the elections.

He said he had raised the objections at the returning officer office but these were rejected and the nomination papers of Imran Khan were accepted. Qazi Jawad Ihsanullah Qureshi submitted to the court had dismissed the petition on the last hearing for being infructuous

He said a supplementary petition was filed as it was feared that the petitioners would face problems in future because of the court verdict.

The counsel said it had been requested to the court to use the word disposed of instead of dismissed and that the petitioner may be allowed to file the petition in future if desired so. The lawyer for Imran Khan said he had no objection to the acceptance of the supplementary petition. The court disposed of the writ for being infructuous and accepted the supplementary petition. It may be mentioned there that earlier Imran Khan had requested the court to dismiss the writ by declaring it not maintainable as he was not a member of the assembly from the constituency.
