Nursing college not part of LRH, declares PHC

PESHAWAR: The Peshawar High Court (PHC) on Thursday declared illegal the decision of the government to make the Graduate College of Nursing as a part of the Medical and Teaching Hospital, Lady Reading Hospital (MTI, LRH).

The court declared null and void the notification on the issue and ordered the revival of the original status of the government. The verdict was handed down by a two-member bench of the PHC consisting of Justice Abdul Shakoor and Justice Syed Arshad Ali.

The writ against the decision had been filed by Vice-Principal of the Provincial Health Services Academy Peshawar, Bibi Sultana.

Asif Yousafzai Advocate appeared for the petitioner. He said a summary was sent to the then chief minister on December 14, 2021 for placing the nursing college under the control of the LRH.

The KP cabinet later approved the summary and subsequently the college was declared part of the LRH. The counsel said a notification was issued on January 31, 2022, to this effect, which, he pleaded, was against the constitution and MTI Act 2015 along with KP Rules of Business.
