Plea against Musharraf rejected; petitioner fined
LAHORE
The Lahore High Court on Friday imposed Rs10,000 fine on a man for filing frivolous application against deletion of Gen (r) Pervez Musharraf’s name from the Exit Control List (ECL) and allowing him to go abroad.
Syed Iqtidar Shah, who also holds US nationality and had been a habitual petitioner, agitated the issue of Pervez Musharraf by filing a civil miscellaneous application in a pending main petition.
Mr Shah pleaded that the former president was facing charges of treason under Article 6 of the Constitution but government allowed him to leave the country. He said the former ruler should not be allowed to leave the country until his trial was concluded. He asked the court to restrain Pervez Musharraf from going abroad and implement Article 6 of the Constitution.
Justice Syed Mansoor Ali Shah took up the application and asked the applicant to apprise as to how implementation of the Constitution could be sought through a civil miscellaneous application. The applicant failed to give satisfactory answer to the court’s query.
Justice Shah observed that the applicant used to file petitions against different personalities for cheap publicity only. He said the court would not encourage such frivolous litigation. The judge dismissed the application and imposed a fine of Rs10,000 on Syed Iqtidar Shah.
