ISLAMABAD: Former Senate chairman and law minister Farook H Naek has said that establishment of the Federal Constitutional Court (FCC) would stall miscarriage of justice at the highest level.
Naek told The News here Wednesday evening that setting up of the court would enable the Supreme Court for adjudicating appeals in criminal and civil matters, which is its prime function under Article 178 of the Constitution.
The matters fall under Articles 199, 184/3 and 186 of the Constitution would become an exclusive jurisdiction of FCC. It will also deal with the Presidential references, matters regarding inter-provincial disputes, question of interpretation of law and Constitution and some other sensitive subjects. The court would not undermine the role of SC that would be discharging its duties under the constitutional orbit, he said.
Farook Naek reminded that creation of the FCC is part of the Charter of Democracy (CoD). Interestingly no political party has ever opposed its creation. He said that PTI’s opposition to FCC is a recent phenomenon otherwise it had never come in the open to oppose it in past. He eulogized the address of PPP Chairman Bilawal Bhutto Zardari in Sindh Bar Council and said he highlighted the voice of justice that has complete support of legal fraternity. To a query, Naek said that the under discussion constitutional amendments will also address some other issues. Once the constitutional amendment for FCC is adopted by parliament and assented by the president, rules of business, appointment of judges, seat of the court and its building would be decided by the authorities concerned.
